The agreement that governs your relationship with our Maison, our boutiques, and our digital ateliers. Please read carefully before placing an order or creating an account.

By engaging with our boutiques, our website, our mobile applications, or any communication channel we provide, you enter into a considered agreement with the Maison. These Terms preserve the integrity of our craft and the trust we share with every client.

01 General Terms & Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and the Maison, its affiliates, subsidiaries, and authorized representatives (collectively, "we," "us," or "the Maison"). By accessing our website, downloading our mobile application, visiting our boutiques, contacting our concierge, or otherwise transacting with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety.

You represent and warrant that you are at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater, and possess the legal capacity to enter into a binding contract. If you are using the services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree with any portion of these Terms, you must discontinue use of our services and refrain from making any purchase. Continued engagement with the Maison after revisions to these Terms constitutes acceptance of the revised Terms.

02 Account Registration & Security

To access certain features, including order tracking, the rewards program, wishlists, and the private client portal, you may create a personal account. You agree to provide accurate, current, and complete information during registration and to maintain such information thereafter.

Account Responsibility

You are solely responsible for safeguarding your account credentials and for any activity occurring under your account, whether authorized or not. We strongly encourage the use of strong, unique passwords and the enablement of multi-factor authentication where available.

Suspension & Termination

We reserve the right to suspend, restrict, or terminate any account at our sole discretion, without prior notice, in cases of suspected fraud, abuse of our policies, violation of these Terms, or for any reason consistent with applicable law. You may close your account at any time by contacting client services.

03 eCommerce & Online Purchases

Pricing & Currency

All prices are displayed in the currency designated for your selected region and are exclusive of applicable taxes, duties, and shipping fees unless explicitly stated otherwise. Prices are subject to change without notice; however, the price applicable to your order will be the price displayed at the time of order confirmation.

Payment

We accept major credit and debit cards, select digital wallets, bank transfers for high-value pieces, and our gift cards. All transactions are processed through PCI-DSS compliant gateways. By submitting payment information, you authorize us to charge the full amount, including taxes and shipping, to the designated payment method.

Order Confirmation & Acceptance

An automated order acknowledgment is not a binding acceptance of your order. Your order is accepted only when we issue a separate shipment confirmation. Until that moment, we may decline or cancel any order for reasons including, but not limited to, suspected fraud, pricing or descriptive errors, inventory unavailability, or inability to verify identity.

Order Cancellation

Orders may be cancelled by the client prior to dispatch by contacting our concierge at [Contact Email]. Once an order has shipped, our standard returns policy applies. Bespoke, engraved, resized, or made-to-order pieces cannot be cancelled once production has commenced.

Pricing Errors In the rare event a piece is listed at an incorrect price due to a typographical or systems error, we reserve the right to cancel the order and issue a full refund, even if payment has been processed.

04 Shipping & Delivery

Domestic Shipping

Complimentary insured shipping is provided on all domestic orders. Standard delivery is typically completed within three (3) to five (5) business days following dispatch. Expedited and same-day options are available in select metropolitan areas at checkout.

International Shipping

International orders are shipped via fully insured, signature-required courier and typically arrive within seven (7) to fourteen (14) business days. The Client is the importer of record and is responsible for any customs duties, value-added taxes, and import fees levied by the destination country. These charges are not refundable in the event of a return.

Risk of Loss

Title and risk of loss pass to the Client upon delivery to the address provided at checkout, evidenced by signature receipt. We strongly recommend specifying a secure delivery address. We are not responsible for items reported as lost or stolen following confirmed delivery to the supplied address.

Address Accuracy

It is the Client's responsibility to provide an accurate, complete, and reachable shipping address. Reshipment of parcels returned due to incorrect addresses or repeated failed delivery attempts may incur additional fees.

05 Returns, Exchanges & Refunds

Return Window

We accept returns of unworn, undamaged pieces in their original packaging, accompanied by all certificates and documentation, within thirty (30) days of delivery. Items must be returned via our complimentary insured return label or an equivalent fully insured courier service.

Conditions

  • Pieces must show no signs of wear, alteration, sizing, or damage.
  • All original packaging, pouches, certificates of authenticity, and gemological reports must be included.
  • Engraved, resized, monogrammed, bespoke, and made-to-order pieces are final sale.
  • Earrings and other intimate items are non-returnable for hygienic reasons unless defective.

Refund Processing

Refunds are issued to the original method of payment within ten (10) business days following receipt and authentication of the returned piece. Original shipping fees, where applicable, and customs duties are non-refundable. A restocking fee of up to fifteen percent (15%) may apply to high-value pieces returned outside the standard window or in altered condition.

Exchanges

Exchanges are processed as a return followed by a new order, ensuring you receive the precise piece desired with current pricing and full insurance.

06 In-Store & Point of Sale Purchases

Receipts & Records

A digital or printed receipt is provided for every boutique purchase. We retain a record of your purchase in our secure systems for warranty, valuation, and authentication purposes.

Price Matching

Boutique pricing reflects the prevailing retail price for our region and may differ from online or international pricing due to currency, duty, and tax considerations. We do not match competitor pricing on third-party platforms or unauthorized resellers.

Layaway & Holds

Select boutiques offer a layaway program for qualifying pieces, typically requiring a non-refundable deposit of twenty percent (20%) and full settlement within ninety (90) days. Specific terms will be provided in writing at the time of layaway initiation.

In-Store Returns

Pieces purchased in a boutique may be returned at any of our boutiques within the same country of purchase, subject to the same conditions described in Section 05.

07 Product Descriptions & Accuracy

We endeavor to describe each piece with the utmost precision, including metal composition, gemstone characteristics, weight, dimensions, and finish. Photography is captured under controlled conditions; however, natural variation, screen calibration, and lighting may produce minor differences between the image and the physical piece.

Gemstone Grading

Where applicable, diamonds and colored gemstones are graded in accordance with industry standards established by independent laboratories such as GIA, AGS, or SSEF. Grading reports accompany qualifying pieces and remain the definitive source of specification.

Metal Purity

All gold pieces are hallmarked in accordance with applicable assay standards (e.g., 18k, 14k, 9k). Platinum pieces meet a minimum 950 purity. Silver pieces are sterling 925 unless otherwise stated.

Natural Variation

Colored gemstones, pearls, and hand-finished pieces possess natural variations in color, inclusion, and luster that are intrinsic to their character and not considered defects.

08 Warranty & Repairs

Manufacturer Warranty

Each piece is accompanied by a two (2) year limited warranty covering defects in materials and craftsmanship under normal wear. The warranty does not cover damage resulting from accident, misuse, exposure to chemicals, unauthorized alteration, or ordinary wear such as prong wear, finish patina, or chain stretching.

Repair Services

Repairs not covered under warranty may be performed by our master ateliers at prevailing rates. An estimate will be provided prior to the commencement of any work. Turnaround times typically range from two (2) to six (6) weeks depending on complexity.

Care Instructions

To preserve the brilliance of your piece, we recommend storing each item separately in its provided pouch, removing jewelry before bathing, swimming, exercising, or applying cosmetics, and arranging an annual professional inspection at any of our boutiques. Detailed care guidance is provided with every purchase.

09 Customer Loyalty & Rewards Program

Earning Points

Members of our Cercle Privé earn points on qualifying purchases at a rate disclosed at the time of program enrollment. Points may be earned in our boutiques and online when an account is associated with the transaction. Taxes, shipping, gift card purchases, and certain promotional purchases are excluded from points accrual.

Redemption

Points may be redeemed toward future purchases, exclusive experiences, or complimentary services in accordance with the program rules in effect at the time of redemption. Points carry no cash value and cannot be transferred, sold, or combined across accounts.

Expiration

Points expire twenty-four (24) months following the date of earning if no qualifying activity occurs on the account. Account closure or termination of these Terms results in immediate forfeiture of all unredeemed points.

Program Modifications

We reserve the right to modify, suspend, or discontinue the rewards program in whole or in part at any time with reasonable notice to active members. Members will retain a minimum of sixty (60) days to redeem accrued points in the event of program termination.

10 Gift Cards & Store Credit

Gift cards may be purchased online or in any of our boutiques and are redeemable across all retail channels operated by the Maison. Gift cards are not redeemable for cash except where required by law and cannot be reloaded once issued unless explicitly stated.

  • Gift cards do not expire and are not subject to dormancy fees.
  • Lost or stolen gift cards cannot be replaced unless registered to a verified account.
  • Store credit issued in connection with a return is non-transferable and tied to the originating account.
  • Balances may be checked at any time via your account or by contacting client services.

11 CRM & Customer Data

We collect and process personal data through our boutique point of sale, online checkout, mobile application, concierge channels, and event registrations. Information collected may include your name, contact details, purchase history, size profile, gemstone preferences, anniversary dates, and other elective preferences shared to enrich our service.

Use of Data

We use this data to fulfill orders, deliver after-sales service, personalize recommendations, provide tailored client outreach, prevent fraud, and improve our services. With your consent, we use aggregated insights to design new collections and curated experiences.

Retention & Rights

Personal data is retained for as long as necessary to fulfill the purposes for which it was collected and to comply with legal obligations. You may request access, correction, deletion, or portability of your data, or object to certain processing activities, by contacting our Data Protection Officer at [Privacy Contact Email]. 12 SMS & Email Marketing Communications

Email

By providing your email address and opting in, you consent to receive marketing communications from the Maison, including new collection announcements, private events, and editorial content. You may unsubscribe at any time using the link in any email or by adjusting preferences in your account. We comply with the CAN-SPAM Act, GDPR, and equivalent local regulations.

SMS & MMS

By opting in to text messages, you authorize the Maison to send recurring marketing and transactional messages to the mobile number provided, using automated technology. Message frequency varies and typically does not exceed eight (8) messages per month. Message and data rates may apply. Consent is not a condition of purchase.

To opt out, reply STOP at any time. For assistance, reply HELP or contact us at [Contact Email]. We comply with the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines.

Transactional Messages

Order confirmations, shipping notifications, repair updates, and appointment reminders are considered transactional and will be delivered regardless of marketing preferences while you maintain an active relationship with the Maison.

13 Push Notifications & App Communications

Our mobile application may deliver push notifications regarding your orders, appointments, exclusive launches, and personalized invitations. You may enable or disable push notifications at any time through your device settings. Disabling notifications may limit certain time-sensitive features such as appointment reminders or limited-edition release alerts.

In-application messages and inbox communications are governed by the same standards as our other channels, and we will not share your device identifiers with unaffiliated third parties for marketing purposes without your explicit consent.

14 Intellectual Property

All content present on our website, mobile application, boutiques, packaging, and marketing materials, including but not limited to the Maison name, logos, monograms, design motifs, photography, illustrations, copy, audiovisual content, and signature collection names, are the exclusive property of the Maison or its licensors and are protected by copyright, trademark, trade dress, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and view this content for personal, non-commercial purposes. Any reproduction, distribution, modification, public display, or commercial use without our prior written authorization is strictly prohibited and may result in legal action.

15 User-Generated Content

By submitting reviews, photographs, videos, social media posts tagging the Maison, or any other content ("UGC"), you grant us a worldwide, royalty-free, sublicensable, and perpetual license to use, reproduce, edit, display, and distribute that content across our marketing, editorial, and commercial channels, with attribution where reasonably possible.

You represent that you own or have secured all rights necessary to grant this license, that the content is original, and that it does not infringe upon any third party's rights or violate any law. We reserve the right to remove or decline to display any UGC at our discretion, including content deemed inappropriate, defamatory, or inconsistent with the values of the Maison.

16 Limitation of Liability & Disclaimers

To the fullest extent permitted by applicable law, the Maison and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of our services, your purchase of any piece, or these Terms.

Our total aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the greater of (a) the amount paid by you for the specific piece giving rise to the claim, or (b) one hundred dollars ($100). Certain jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted.

The services and pieces are provided on an "as is" and "as available" basis. While we strive for excellence, we do not warrant that the services will be uninterrupted, error-free, or free from malicious code.

17 Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of [Governing Jurisdiction], without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, our services, or your purchase shall first be addressed through informal good-faith negotiation between the parties for a period of at least sixty (60) days.

Should informal resolution fail, disputes shall be finally resolved by binding arbitration administered by [Arbitration Body] in accordance with its rules then in effect, and judgment on the award may be entered in any court of competent jurisdiction. You waive any right to participate in a class action, class arbitration, or representative proceeding to the fullest extent permitted by law.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.

18 Modifications to Terms

We may revise these Terms from time to time to reflect changes in our practices, our offerings, or applicable law. The most current version will always be available on our website with the effective date noted at the top. Material changes will be communicated to active account holders via email and through prominent notice on our website at least fifteen (15) days prior to taking effect.

Your continued use of our services following the effective date of any revision constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of our services prior to the effective date.
